This site, accessible via the URL www.huguette.co is published by Opus Grande, owner of Huguette, SASU with a share capital of 1500€ euros, registered with the R.C.S. of Toulouse under the number 909 286 387, whose head office is located at 3 rue Henri Béraldi, 31000 Toulouse, France, VAT number FR50 909 286 387 - Telephone : 06.51.17.87.13.

Hereinafter referred to as the "operator".

DEFINITIONS

Article: women's fashion products offered for sale on the e-commerce site. The clothes and accessories are handmade in the south of France in limited series or in unique piece in quality fabrics (dormant stock of the houses of high fashion or creators, vintage fabric, fabric of the current collections labelled GOTS, Oeko-Tex, Vegan approved or Fair wear). There is no fabric manufacturing, nor stock. The pieces are made to order. The goal is to make local craftsmen work and to make the made in France accessible. The Products presented on the site are each the subject of a description established by the operator, mentioning their essential characteristics. The photographs illustrating, if any, the products do not constitute a contractual document.

Customer: non-trading natural person placing an order and having full legal capacity.

Order: commitment to purchase all items selected by the customer via the e-commerce service of the site.

GENERAL PROVISIONS RELATING TO THE PRESENT GENERAL TERMS OF SALE

The general terms and conditions of sale, more commonly known as "GTC", are applicable exclusively to the online sale of products offered by the operator on the site or during pop-up or other ephemeral sales.

The GTC are made available to customers on the site where they can be directly consulted and can also be communicated to him on request by any means.

The GTC are opposable to the customer who recognizes to have had knowledge of them and to have accepted them before placing order. The validation of the order by its confirmation is worth adhesion by the purchaser to the CGV in force at the day of the order whose conservation and reproduction are ensured by the operator. These GTC prevail over any other document.

Taking into account the possible evolutions of the site and the regulations, Huguette reserves the right to modify the GTC at any time. The new GTC will, if necessary, be brought to the attention of the customer by online modification. The GTC applicable to any sale are those appearing on the site at the time of the order.

 

CREATION OF A CUSTOMER ACCOUNT

When placing an order on the site, the customer can, if he wishes, create a personal account. Once created, to access it, the customer must identify himself using his email address and his secret, personal and confidential password. It is up to the customer not to communicate his password. Each customer undertakes to keep the data strictly confidential and to inform the operator without delay in the event of loss, misappropriation or fraudulent use of his identifier (email address) and/or password.

After the creation of his personal customer area, the customer will receive an email confirming the creation of his customer area. The creation of an account and the purchases carried out thereafter are reserved for the natural persons not tradesmen or with the major holding the full legal capacity. Minors with parental permission (or guardian holding parental authority) are also.

The Customer commits himself during his registration to :


- Provide real, accurate and up-to-date information at the time of their entry in the registration form of the service, and in particular not to use false names or addresses, or names or addresses without being authorized.

- To keep the registration data up to date in order to ensure that it is real, accurate and up to date at all times.

 Huguette reserves the right to close any account and to refuse any sale to a customer in the following cases

- Failure to pay for one or more previous orders
- Abusive, unfair or fraudulent use of the ordering service offered on the site or failure to respect any of the customer's obligations defined in the GTC
- The customer has not responded to a request for confirmation of his order that the operator has sent him
- Previous orders obviously validated by a professional seller customer, or quantity of products exceeding the normal needs of a consumer.

ITEMS

The items offered for sale are those which appear on the website www.huguette.co on the day of consultation by the customer, within the limits of available stocks.

Huguette reserves the right to withdraw from the sale or to replace, at any time, any article present on the site, as well as to modify all information associated with these articles.

The indications concerning the availability of the articles are automatically updated in real time. However, Huguette cannot be held responsible for any error in the update, whatever its origin. In this respect, Huguette cannot be held responsible for the cancellation of an order for an article due to the exhaustion of stocks. In the event that an item is not available, after placing the order, the customer will be informed by e-mail, his order will then be automatically cancelled and the refund of the item will be made at the latest within 30 days from the date of payment of the sums already paid.

The characteristics of the items sold on the site (photos, graphics, descriptions ...) may change over time. Only the characteristics indicated at the time of the order must be taken into account by the customer. In case of major errors or omissions in the description of an item, Huguette's responsibility will be limited to the reimbursement of the reasonable costs of returning the item + the value of the item, sent by the customer.

It is possible that the customer may receive a piece returned by another customer after placing an order. It is specified that Huguette only accepts the return of new, unworn, unwashed items, with label and in their original packaging. These conditions are checked by the operator before the returned items are put back in stock and refunded.

-Velvet: dry clean only
-Silk & satin: hand wash cold or dry clean
-Wool & viscose: hand wash cold only
Gentle ironing for all fabrics.

Do not tumble dry.
Do not use bleach.

Space out the washings to preserve the planet.

ORDERS

With the exception of any mention to the contrary in these General Conditions and without prejudice to the right of withdrawal provided for by the applicable law, the Customer's orders are firm and definitive.

When placing an order, the customer must select the products chosen, add them to his basket by indicating the products selected and the quantities desired. The customer has the possibility to check the details of his order and its total price, and to return to the previous pages to possibly correct the contents of his basket, before validating it.

The Customer agrees to read the current GTC before accepting them and to confirm the terms and conditions and any delivery charges, prior to payment of the order. Confirmation of the order constitutes acceptance of the GTC and forms the contract. The contractual information relating to the order (including the order number) will be confirmed by email in due course and at the latest at the time of delivery.

Any email that will be sent to the customer in the context of an order will be sent to the email address that the customer uses to identify himself in his customer area.

The customer will be able to obtain the invoice relating to any order by sending an e-mail specifying the number of the order concerned to contact@huguette.co.

Any modification of the order by the customer after confirmation of his order is subject to the agreement of the operator.

The information communicated by the customer when placing the order (name, delivery address, etc.) is binding. Thus, Huguette cannot be held responsible in the event that an error in the order would prevent or delay the delivery of the ordered items.

The orders are open as indicated in the section "creation of a customer account" to the capable adults and to the minors provided that they intervene under the supervision of the parent or tutor holding the parental authority. In no case, an order is authorized on behalf of a third party unless he/she is validly authorized to represent it (legal person for example). The order is strictly personal to each customer.

PRICE

The price in force is indicated in euros and all taxes included (TTC) excluding delivery/transportation, customs and other taxes to France or international destination.

Any additional costs related to the conversion of a foreign currency, according to the payment method chosen by the customer, are not taken into account in the price indicated, nor are they charged to Huguette.

Any new taxes or contributions, notably environmental, are likely to be reflected in the selling price of the articles.

The delivery or transport costs will be indicated separately before the validation of the order to the customer. The total amount due by the customer and the details are indicated on the order confirmation page.

The price is payable in Euros (€). The price is due in full after confirmation of the order.

Huguette reserves the right to modify the prices of the articles at any time, the articles being invoiced on the basis of the prices in force at the time of the validation of each order, subject to their availability.

In case of a promotion, the operator commits himself to apply the promotional price to any order placed during the period of the advertisement made for the promotion.

BREXIT

Zones UK, Ireland, Scotland, Great Britain

By ordering from Huguette, you agree to pay the VAT that will be claimed by the customs. If you refuse to pay the VAT, the package will be returned to us and the VAT charges will be applied twice (import/export). We will then be obliged to deduct these fees from your refund. In case of refusal, your parcel will be destroyed by the customs service and we will not be able to proceed to the refund of this one.

RESERVATION OF OWNERSHIP

The operator remains the exclusive owner of the products ordered on the site until receipt of the full price, including any shipping costs.

TERMS OF PAYMENT

The articles are payable cash at the time of the effective order or in 3X without expenses with Klarna.

It is also possible to pay in 2X without fees by secure payment link Sumup: 50% at the time of the order and 50% at the time of the expedition (at 1 month interval). For that, it will not be necessary to pass by the site directly, but to make its request by email to: contact@huguette.co.


The payment of the articles is carried out either by bank card (CB, visa, mastercard, american express) by the protected platform Shop pay of Shopify, or in 3x without expenses with Klarna or in 2x without expenses with Sumup.

The customer expressly recognizes that the communication of his credit card number to Huguette is equivalent to an authorization to debit his account up to the price of the articles as indicated at the time of the order confirmation. If necessary, Huguette will notify the customer of the cancellation of the order for non-payment on the e-mail address communicated by the customer when registering on the site.

The data recorded and kept by Huguette constitute the proof of the order and of all sales made. The data recorded by Shop pay, Klarna or Sumup constitute the proof of any financial transaction between the customer and Huguette.

SHIPPING AND DELIVERY

Delivery means the transfer to the customer of the physical possession of the item(s).
The online sales offers present on the site are reserved for consumers residing in France or in a member country of the European Union, and for deliveries in these same geographical areas.

The shipping costs are those specified at the time of finalizing the order and are accepted by the validation of the order.

Huguette undertakes to ship the items in accordance with the delivery date indicated on each product page of the site, i.e. within a maximum of 45 days (1 month and a half) after receipt of the order, provided that the payment has not been previously refused. However, if one or more products could not be delivered within the time initially announced, the operator will send an email indicating to the customer the new delivery date.

The customer may also write directly to contac@huguette.co to be kept informed of the status of the delivery and to agree on a reasonable extension. If the customer has still not received his order at the end of this new period, he can denounce the sale by writing to the same email address and obtain within a maximum of 14 days the refund of the articles not sent, via the means of payment used during this order.

The delivery times are announced in working days. These times include the preparation and shipment of the order as well as the time required by the carrier. Huguette cannot be held responsible for any delay in delivery that is not due to Huguette's fault or that is justified by a case of force majeure.

The products will be delivered to the address indicated by the customer when ordering. It is therefore his responsibility to check that this address does not contain any error. The responsibility of the operator can not be engaged if the address provided by the customer is incorrect, preventing or delaying the delivery. The delivery cannot be made to hotels or post office boxes.

The risk of loss or deterioration of the item(s) is transferred to the customer at the time of delivery.

Upon validation of the order, the customer is offered standard shipping by the Post Office.  The offered shipments will be sent by Mondial Relays systematically.

RETURN EXCHANGE AND REFUND

1/ For all items already produced and available for sale

The return or exchange of items will only be accepted if the items are returned in perfect condition, new, never worn, with label, in their original packaging within 14 days from the delivery date. If the deadline expires on a Saturday, Sunday, holiday, or another non-business day, it will be extended to the next business day. Beyond that date, Huguette reserves the right to refuse the return or the refund. After a control, upon receipt of the parts, Huguette will have a maximum of 30 days to proceed with the refund, using the payment method that was chosen by the customer at the time of the order. The reimbursement costs will be at your expense, except in the case where the product is returned due to the operator's responsibility (faulty workmanship, damaged fabric), by providing formal proof. The request must be made by email to the address: contact@huguette.co

It will not be possible to return a piece made from a vintage fabric if the reason for return is similar to the following: "used fabric, patina, defect/irregularity in the weft". The pieces made from vintage fabric will be clearly indicated on the product sheets of the site, the vintage fabrics have all been washed before being made for hygienic reasons, they are sheets, curtains, old tablecloths that have been used and have patina over the years, which makes their charm.

It will be possible to make a minor modification on the ordered piece, but the expenses of return of retouching and new sending will be chargeable to the customer.

According to the article L..121-20-2 of the code of the consumption, the right of retraction does not apply "to the supply of goods made according to the specifications of the consumer or clearly personalized", in this case the part will not be refundable.

2/ For all pre-ordered items and hair accessories

Insofar as the pieces are made by hand, in very small series or in unique pieces following your order (choice of model, size and fabric), that the fabrics are also very limited in stock and not followed, the pieces have a unique character, they will therefore be neither exchangeable nor refundable.

The hair accessories (scrunchie, hairband) will not be exchangeable or refundable for reasons of hygiene.

CUSTOMER SERVICE

The Customer can contact the operator by email at contact@huguette.co indicating his name, telephone number, the subject of his request and the number of the order concerned, or by telephone at: 06.51.17.87.13 from 9:30 am to 6:30 pm, excluding public holidays (not surcharged).

In the event of difficulty arising at the time of the purchase of an article on the site, the customer is invited to contact the operator in order to reach an amicable settlement.


COMMERCIAL OFFERS AND NEWSLETTERS

Huguette is likely to send customers information about articles and commercial offers by mail, e-mail, sms, telephone or via all the web spaces animated by the brand on social networks, subject to prior acceptance. The customer has at any time the right to object to these commercial prospecting mailings at no cost: By mail or by telephone, by sending a clear statement to the e-mail address contact@huguette.co or to the following postal address: Huguette, 3 Rue Henri Béraldi, 31000 Toulouse By e-mail, by clicking on the "unsubscribe" link at the bottom of each e-mail; By all the web spaces animated by Huguette on social networks, by unsubscribing from the page.

COOKIES

During the consultation of the site, information relating to the navigation of customers may be recorded in "cookies" files installed on their terminal (computer, tablet, smartphone).

These cookies are issued in order to facilitate navigation on the site and to recognize the customer's browser when they are connected to the site.

Cookies are installed only after acceptance by the customer, the continuation of the navigation on the site being considered as acceptance.

Most browsers accept cookies automatically, but customers can choose whether or not to accept cookies at any time from their browser settings, often located in the "tools" or "preferences" menu of their browser.

Any settings implemented by the client may negatively affect the user experience and parts of the site may not be accessible in their entirety.

Huguette is not responsible in any way for the content or operation of social networks, including those that may be linked to the site. To understand how the social network sites use information about the customer's activities on our website and on the Internet, the customer is encouraged to read their respective terms of use and privacy policies. If the customer does not want the social networks to link the information collected through the site to the customer's account, the customer should log out of the relevant social network before visiting the site.

DATA PROTECTION

The Operator processes the customer's personal data for the purpose of concluding the contract, its execution, administration and invoicing.

The recipient of the data is the operator. However, the operator reserves the right to pass on all or part of the customer's personal data to its subcontractors for the purpose of fulfilling the order (in particular the delivery of products).

In accordance with the applicable regulations, the customer has various rights that he can exercise at any time, including a right of access, a right of rectification, a right to erasure or limitation of the processing of his data.

To exercise these rights, the customer is invited to send his request by e-mail to contact@huguette.co, mentioning his name, first name(s) and contact details (telephone number and e-mail address). He may be asked to prove his identity. The customer has the possibility of lodging a complaint with the CNIL.

INTELLECTUAL PROPERTY AND LICENSE TO USE THE SITE

The operator is the sole owner of all the elements present on the site, in particular and without limitation, all texts, files, images animated or not, photographs, videos, logos, drawings, models, software, trademarks, visual identity, database, structure of the site and all other elements of intellectual property and other data or information that are protected by French and international laws and regulations relating to intellectual property.

Consequently, none of the elements of the site may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented or exploited in any other way, whether free of charge or for a fee, by a customer or by a third party, whatever the means and/or media used, whether known or unknown to date, without the prior express written authorization of the operator on a case-by-case basis, and the customer is solely responsible for any unauthorized use and/or exploitation.

The operator reserves the right to take legal action against any person who does not comply with the prohibitions contained in this text.

 

RESPONSIBILITY

The customer remains responsible for the modalities and consequences of his access to the site, in particular via the Internet. This access may involve the payment of fees to technical service providers such as Internet access providers, which remain at the customer's expense. Moreover, the client must provide and be entirely responsible for the equipment necessary to connect to the site.

Huguette cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, a break in service, an external intrusion or the presence of computer viruses or any event qualified as force majeure, according to jurisprudence.

The hypertext links present on the site in the direction of other resources present on the Internet network cannot engage the responsibility of the operator. Indeed, the operator has no means to control the content of these third-party sites, which the customer is expressly informed under the present. Consequently, the risks related to this use are fully incumbent on the Internet user, who must comply with the specific conditions of use of each third-party website.

LEGAL GUARANTEES

All Products sold on the site benefit from the legal guarantee of conformity provided for in Articles L. 217-4 and following of the Consumer Code, as well as the guarantee against hidden defects provided for in Articles 1641 to 1649 of the Civil Code.

GENERAL PROVISIONS

1/ Entire agreement of the parties

These GTC constitute a contract governing the relationship between the customer and operator. They constitute the entirety of the rights and obligations of the Company and the operator relating to their subject matter. If one or more stipulations of the GTC are declared null and void in application of a law, a regulation or following a final decision of a competent court, the other stipulations will keep all their force and their scope. In addition, the fact that one of the parties to these GTCs does not take advantage of a breach by the other party of any of the provisions of the GTCs shall not be construed as a waiver on its part to take advantage of such a breach in the future.

2/ Changes to the conditions

The operator reserves the right to modify at any time and without notice the content of the site or the services available on it, and/or to temporarily or permanently cease operating all or part of the site.

In addition, the operator reserves the right to modify at any time and without notice the location of the site on the Internet, as well as these GTC.

The customer acknowledges that the operator cannot be held responsible in any way whatsoever towards him or any third party because of these modifications, suspensions or cessations. The GTC applicable to the customer are those available at the date of the order. It is therefore specified that any modification of the GTC that would be made by the operator will not apply to any order previously placed, unless expressly agreed by the customer at the origin of a given order.

3/ Applicable law

These General Conditions are governed, interpreted and applied in accordance with French law.

4/ Acceptance of the general conditions by the customer

The Customer acknowledges having carefully read the present GTC.
By ordering on the site, the customer confirms that he/she has read the General Terms and Conditions of Sale and accepts them, making him/her contractually bound by the terms of these GTC.
